These Website Terms & Conditions (“Terms”) govern all bookings, use of this website, and rental transactions made directly with Richard and Deborah Bradd, owners of Rest Cottage of Texas (“we,” “us,” “Hosts”). By making a reservation on this website, you (“Guest”) agree to these Terms.

1. Direct Booking Relationship

Bookings made on this website constitute a direct agreement between the Guest and Hosts. These Terms apply in addition to the Short-Term Rental Contract that the Guest must sign before arrival.

Failure to sign the required Rental Contract may result in cancellation of the reservation without refund.

2. Accuracy of Information

We make every effort to ensure that information on this website is accurate.
However, we do not guarantee that all descriptions, availability, pricing, or images are error-free.
We reserve the right to correct errors, update information, or modify details at any time.

3. Reservation Requirements

To book directly on this website, the Guest must:

• Be at least 25 years old,

• Use a valid payment method,

• Provide accurate personal information, and

• Agree to all Terms and the Rental Contract.

We reserve the right to refuse or cancel any reservation at our discretion.

4. Payment Terms

Payment is processed via our secure payment provider.
By booking, Guest authorizes us to:

• Charge the full reservation amount,

• Charge for additional fees or damages per the Rental Contract,

• Charge any outstanding balance.

Chargebacks filed after check-in are considered a violation of these Terms.

5. Cancellation Policy

The cancellation policy displayed on the website at the time of booking applies.

Because our home is held exclusively for your stay, cancellations within the defined non-refundable period will not receive a refund.

6. Chargebacks & Fraud Protection

Guest agrees not to initiate chargebacks for charges related to:

• Rent,

• Cleaning fees,

• Damage fees,

• Rule violations,

• Cancellations that fall within the non-refundable window.

All documentation—including signed contracts, communications, and evidence—will be submitted to the payment processor in response to any chargeback.

Fraudulent or suspicious bookings may be cancelled without refund.

7. Required Rental Contract

A signed Short-Term Rental Agreement is required for all direct bookings.
If the Guest refuses to sign, the reservation will be cancelled without refund.

This website’s Terms do not replace the Rental Contract.

8. Third-Party Bookings

The Primary Guest making the reservation MUST:

• Be the person staying at the property,

• Sign the rental contract,

• Be present for the full duration of the stay.

Reservations made on behalf of others are strictly prohibited.
If discovered, the booking will be cancelled without refund.

9. House Rules & Policies

All House Rules published on this website or provided in the home binder or listing are incorporated into these Terms.

Violations (including unauthorized visitors, parties, parking issues, noise complaints, smoking, or safety violations) may result in:

• Immediate removal without refund,

• Additional cleaning fees,

• Damage charges.

10. Property Use & Safety

Guest assumes all risk associated with use of:

• Pool,

• Stairs,

• Outdoor areas,

• Rural conditions (insects, wildlife, noises, etc.)

Hosts are not liable for:

• Injuries resulting from misuse,

• Failure to supervise children,

• Alcohol use,

• Negligent behavior.

11. Website Use Terms

Guests agree not to:

• Attempt unauthorized access to backend systems,

• Use the website for fraudulent bookings,

• Copy or misuse content, images, or materials.

All website content is protected by copyright.

12. Privacy & Data Handling

We store only the information needed to process your booking, including name, contact details, and reservation details.
All payments are handled through secure third-party processors (Lodgify/Stripe/PayPal).

We do not sell or share personal information.

13. Liability Limits

To the fullest extent permitted by Texas law:

• Hosts are not liable for losses, damages, injuries, or cancellations outside our control.

• Hosts are not responsible for disruptions caused by weather, power outages, local noise, construction, or rural environmental factors.

Total liability shall not exceed the amount paid for the booking.

14. Governing Law

These Terms are governed by the laws of the State of Texas.
Any disputes shall be resolved exclusively in Denton County, Texas.
